Whistle-blowing

Whistle-blowing occurs when a worker discovers that something is wrong and alerts his employer or a relevant authority to that wrongdoing.

A worker who makes a qualifying disclosure to a specified category of persons is protected from suffering a detriment.

What is a qualifying disclosure?

A qualifying disclosure is one or more of the following kinds:

  • criminal offences
  • failure to comply with a legal obligation
  • miscarriages of justice
  • threats to an individuals health and safety
  • damage to the environment; or
  • deliberate attempts to cover up any of the above
