The right to maternity leave

Employees are entitled to 26 weeks ordinary maternity leave irrespective of the length of service or numbers of hours worked. To qualify for ordinary maternity leave, the employee must:

  • by the end of the 15th week before the week of expected childbirth, notify the employer of the pregnancy, the expected week of childbirth and the date on which the employee intends their ordinary maternity leave to start.
  • produce for inspection a certificate from a registered medical practitioner or registered midwife stating the expected week of childbirth.

Employees who are entitled to ordinary maternity leave are automatically entitled to a further 26 weeks additional maternity leave.
